Using the information in the complaint affidavit and Dr.’s report provide an opinion regarding competency to proceed.
Use the Dusky Standard and the following 6 dimensions to answer the question:
In considering the issue of competence to proceed, consider and specifically include in your report the defendant’s capacity to:
Appreciate the charges or allegations against the defendant.
Appreciate the range and nature of possible penalties, if applicable, that may be imposed in the proceedings against the defendant.
Understand the adversarial nature of the legal process.
Disclose to counsel facts pertinent to the proceedings at issue.
Manifest appropriate courtroom behavior.
Testify relevantly.
Support your response using information contained in the supplemental materials (affidavit and report). (For example: If you say she does not appreciate the charges, you need to state why, if you say she does, you need to state why.)
Format = 5 points… The format for this paper should be as such (i.e., Anything that is bold should be bold, anything in all caps should be in all CAPS, anything underlined should be underlined…):
OPINION (10 points): Formal Opinion of Competency. Then restate Dusky Standard.(this should be 1-3 sentences).
Examples:
Ms. Whitmore is competent to proceed at this time. She has sufficient present ability……
Ms. Whitmore is not competent to proceed at this time. She does not have sufficient present ability….
COMPETENCY ISSUES (30 points): State opinion on each of the 6 dimensions (5 points each dimension) and use information from supplemental materials to support your opinion. Have each one separately. Examples:
a. Ms. Whitmore was not able to appreciate the charges or allegations she is facing. She was not able to provide an accurate description of the charges. Her description was delusional in nature. For example, she stated she was arrested because the police were trying to falsely imprison her because she was a woman.
b. Ms. Whitmore appreciates the possible penalties she is facing. In relation to her charges, Ms. Whitmore stated she could face up to 5 years in prison. She stated her charges were felonies and further indicated that felonies carried more time than misdemeanors

CONCLUSIONS (5 points): Ms. Whitmore is competent to proceed at this time/not competent to proceed at this time. Restate her ability on Dusky Standard. Use descriptors from the evaluation to support your opinion. What areas/dimensions of competency are being affected (if any)? To what degree (if any) do her mental health symptoms impact her abilities related to competency? Why? Support your response.
RECOMMENDATIONS (5 points): Any recommendations you may have for her to become competent or maintain competency (depending on your opinion).
